ADA (The Americans with Disabilities Act) Compliance.

ADA compliance, though highly recommended, is not yet mandatory for independent websites in California. Currently, California AB 434 only requires that all websites of state agencies and entities must be accessible to users of all abilities. But this may change.

AB1757, an existing bill on courts, could be amended to make WCAG 2.1 (Web Content Accessibility Guidelines) the required standard for websites and mobile apps thus making it de facto mandatory for all websites owner to become ADA compliant.

“AB 1757 is presently in the Senate Judiciary Committee for consideration of these amendments. If approved by the requisite committees and vote of the full Senate, the bill would then return to the Assembly for concurrence in the amendments by September 14 before going to the Governor for his approval. If this bill becomes law in its present state, it could well open the floodgates of website and mobile app accessibility lawsuits in California.” (Excerpt from Seyfarth on adatitleiii.com/ June 2023).
